Building Code Requirements in Baden-Württemberg

Baden-Württemberg’s building law is the Landesbauordnung Baden-Württemberg (LBO BW), currently in force. As with every Land, it’s the LBO — not the national Musterbauordnung model — that actually binds you here.

Minimum room height (lichte Raumhöhe): 2.30 m, set directly in §34(1) LBO BW — lower than the 2.40 m most other Länder use. In a roof space, that reduces further to 2.20 m over at least half the room’s floor area, with any part of the room under a lower clear height simply not counting toward that half.

Baden-Württemberg is also one of the few Länder where the boundary-setback (Abstandsflächen) rule is confirmed: the general depth factor is 0.4 × wall height, with a minimum absolute depth of around 2.5 m — per §5(7) LBO BW. Reduced rates apply in some zoning categories — confirm those against §5(7) LBO BW directly. Your LBO also sets guard/parapet (Umwehrung) heights and permit-free (verfahrensfrei) thresholds for garages and carports — these weren’t independently confirmed for Baden-Württemberg, so check them directly in the LBO BW text on landesrecht-bw.de before you build to a number.
