Building Code Requirements in Niedersachsen
Niedersachsen's NBauO uses an unusual ⅔-floor-area rule for its 2.40 m room-height minimum, confirmed in §43. Other figures need checking against the statute directly.
Niedersachsen’s building law is the Niedersächsische Bauordnung (NBauO), currently in force.
Minimum room height (lichte Raumhöhe): 2.40 m over at least two-thirds (⅔) of the room’s floor area, set in §43(1)–(2) NBauO — an unusual fraction, since most other Länder use a half (½) test for their reduced-area rule. In a top-storey roof space, the figure reduces to 2.20 m over at least half the floor area.
Niedersachsen sets its boundary-setback (Abstandsflächen) rule in §5 NBauO — confirm the depth factors against the statute directly rather than relying on a figure here.
Your LBO also sets permit-free (verfahrensfrei) thresholds for garages and carports, and guard/parapet (Umwehrung) heights — neither was independently confirmed for Niedersachsen, so check the NBauO text on voris.niedersachsen.de directly before you build to a number.
